Where Can You Legally Buy Shrooms in the U.S.? A State-by-State Reality Check
A plain answer to the most common psilocybin question: where sales are legal, where possession is decriminalized, and what changes in 2026.
The legal map, honestly
Psilocybin is a Schedule I substance federally. Nothing any state does changes that. What states can do is decide how their own laws treat it, and three tiers have emerged.
Tier 1: Licensed supervised access (Oregon, Colorado)
Adults 21+ can legally consume psilocybin at a licensed Oregon service center or Colorado healing center. Product is lab-tested, dosing is measured, and a licensed facilitator supervises. You cannot buy product to take away. Colorado additionally decriminalized personal possession, gifting without payment, and home cultivation for adults 21+.
New Mexico enacted a medical psilocybin program in 2025. It is still in rulemaking, so there is no legal access there yet.
Tier 2: Decriminalized possession, illegal sales
A growing list of cities and a few states have reduced or removed penalties for personal possession: Ann Arbor and Detroit, Michigan; Oakland, Santa Cruz, San Francisco and Berkeley, California; Washington D.C. (Initiative 81); Seattle, Washington; Denver, Colorado; Somerville, Cambridge, Northampton, Easthampton, Salem, Medford, Provincetown and Amherst, Massachusetts; Minneapolis, Minnesota; Ferndale and Hazel Park, Michigan; Detroit; Portland, Maine.
In every one of these places, selling is still illegal. Decriminalization is about how police prioritize personal-use offenses, not about creating a market. The storefronts that have opened in these cities operate in a gray zone and can be — and have been — raided.
Tier 3: Fully illegal
Everywhere else. Possession is a criminal offense with penalties that vary widely by state. Spore purchases are legal in most states (spores contain no psilocybin) but illegal in California, Georgia, and Idaho.
What about Amanita muscaria?
Completely different legal category. Amanita muscaria contains muscimol, not psilocybin, and is not federally scheduled. It is legal to buy and sell in most states — Louisiana is the notable exception. This is why so many shops advertise "legal mushrooms": they mean Amanita, not psilocybin.
What's moving in 2026
Several states have active bills: New Mexico is standing up its medical program, and legislation has been introduced or reintroduced in Illinois (the CURE Act), Massachusetts, Arizona, Washington, and Texas (largely ibogaine and research funding). Massachusetts voters rejected a legalization measure 57–43 in 2024, which slowed the ballot-initiative path nationally.
The practical takeaway
If you want legal psilocybin today, the answer is a booked session in Oregon or Colorado. If you want something legal over the counter, the answer is an Amanita or functional-mushroom product. There is no third legal option, whatever a storefront's sign says.
