In April 2025, New Mexico's governor signed Senate Bill 219, the Medical Psilocybin Act, making New Mexico the first state to create a medical psilocybin program through its legislature rather than a ballot measure. The Department of Health is charged with writing rules, licensing producers and clinicians, and standing up an advisory board before patients can be served.
The program is medical, not retail. Qualifying conditions named in the law include PTSD, treatment-resistant depression, substance-use disorder, and end-of-life care, with the advisory board able to add more. Patients will receive psilocybin under clinical supervision — there will be no walk-in dispensary model, and possession outside the program stays illegal.
Licensing and rulemaking are still in progress, so there are no open centers to list yet. Mushy Guide will add every licensed New Mexico provider as the Department of Health publishes them. Until then, Oregon and Colorado remain the only states where an adult can legally book a supervised psilocybin session.
